Preamble

These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions to commercial transactions relating to products offered for sale by "AUX ATELIERS DE PAPYMOUSSE SPRL."

Definitions

The words or expressions used in these general terms and conditions of sale or on the website www.boutiquepapymousse.be shall be interpreted as follows:

www.boutiquepapymousse.be : is the online store of "BOUTIQUE PAPYMOUSSE" located at Rue du Noyer 29a, 1000 Brussels, where products are displayed and sold to customers.
Order : refers to the sales contract concluded between the customer and the company "AUX ATELIERS DE PAPYMOUSSE SPRL".
Products : refers to all goods offered for sale by BOUTIQUE PAPYMOUSSE
Transaction : refers to all operations, secure processing, authorizations, and agreements inherent in the payment of the price of products ordered on the website www.boutiquepapymousse.be

Acceptance of terms and conditions

The customer acknowledges having read, at the time of placing the order, these general terms and conditions of sale and expressly declares that they accept them without reservation. Confirmation of the order constitutes acceptance of the general terms and conditions of sale.

Subject

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which BOUTIQUE PAPYMOUSSE offers and sells products.

These general terms and conditions govern all the steps necessary for placing an order and ensure the follow-up of this order between the contracting parties.

Order

All data provided by the customer when entering information relating to their order is binding on the customer. BOUTIQUE PAPYMOUSSE cannot under any circumstances be held liable for errors made by the customer in entering the details of the recipient of the order (delivery address, billing address, etc.) and for any delays in delivery or inability to deliver the products ordered that these errors may cause.

Automatic recording systems are considered proof of the nature, content, and date of the order.

BOUTIQUE PAPYMOUSSE reserves the right to refuse or cancel any customer order, particularly in the event of customer insolvency or in the event of a payment issue for the order in question or a dispute relating to the payment of a previous order, and in the event of a request that is contrary to our ethics and good morals.

Virtually all of our products are in stock. If the product ordered is no longer immediately available, BOUTIQUE PAPYMOUSSE will inform the customer by email of the delivery time. If the customer is not satisfied with the delivery time, they may choose to modify or cancel their order.

Only legally competent persons may place orders.

Delivery

After confirmation of the order and acceptance of payment for the transaction, BOUTIQUE PAPYMOUSSE undertakes to ship the products ordered to the customer at the delivery address provided, generally within 2 to 5 business days depending on the product ordered and the destination. In the event of a delay, the customer will be notified by email.

By placing an order, the customer agrees to pay, upon receipt of their order, all taxes, duties, levies, and other charges, present and future, due in connection with the delivery of the products ordered. BOUTIQUE PAPYMOUSSE cannot be held jointly and severally liable in this regard under any circumstances.

Customers or recipients of the products are prohibited from reselling the products, either in part or in whole.

Delivery is carried out by BPost. All delivery rates are detailed when placing the order. No compensation may be claimed from BOUTIQUE PAPYMOUSSE or the carrier by the customer in the event of a delay in delivery.

Upon receipt of the ordered products, the customer or recipient must check that the product is in good condition. In the event that one or more of the ordered products are missing or damaged, the customer or recipient must immediately make the necessary reservations to the carrier at the time of delivery AND by email to BOUTIQUE PAPYMOUSSE within 24 hours of receipt of the package.

If a package is not claimed after the carrier has attempted delivery unsuccessfully, it will be returned to BOUTIQUE PAPYMOUSSE and the recipient will be notified by email. The buyer may request an additional delivery and will be responsible for the costs (even if the first shipment was free of charge).

Withdrawal

In accordance with current legislation on distance selling (law of April 6, 2010), the customer has the right to cancel their purchase without penalty and without giving any reason, within 14 calendar days of receiving the products ordered.

These products will be returned to BOUTIQUE PAPYMOUSSE for exchange or refund.

The customer must return the new products (with the delivery note) at their own expense and under their own responsibility in their original packaging, intact, accompanied by any accessories, labels, and documentation to the following address: BOUTIQUE PAPYMOUSSE – Rue du noyer 29a, 1000 Brussels.

If the products are returned in accordance with the above conditions and deadlines, Boutique Papymousse undertakes to refund the amounts paid by the customer (excluding delivery costs) free of charge.

If the initial delivery costs were paid by BOUTIQUE PAPYMOUSSE, they will be deducted from the amount refunded to the customer. The refund will be made within a maximum of one month from the date of receipt of the goods by BOUTIQUE PAPYMOUSSE.

Price

The price indicated on the product sheets does not include shipping costs.

The price indicated in the order confirmation is the final price, including all taxes and VAT. This price includes the price of the products, handling, packaging, and storage costs, as well as shipping costs.

Prices are quoted in euros and are subject to change at any time by BOUTIQUE PAPYMOUSSE.

Products are invoiced based on the prices in effect at the time of the order.

Payment

The price of the products is payable in cash using one of the payment methods offered on the website on the day of the order.

Liability

BOUTIQUE PAPYMOUSSE has only an obligation of means for all stages of access to the site, the ordering process, delivery, or after-sales services.

BOUTIQUE PAPYMOUSSE cannot be held liable for any inconvenience or damage inherent in the use of the internet, including service interruptions, external intrusions such as computer viruses, or any event classified as force majeure in accordance with case law.

BOUTIQUE PAPYMOUSSE cannot under any circumstances and in any way be held liable for damages of any kind that may result from improper washing or misuse of the products sold.

The same applies to any changes to products made by manufacturers.

BOUTIQUE PAPYMOUSSE shall in no way be required to compensate for "normal" wear and tear on the products sold.

BOUTIQUE PAPYMOUSSE's liability shall, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have remained despite all the precautions taken in the presentation of the products.

The product photos on the website are provided for informational purposes only. Under no circumstances may a slight modification to a product or a slight alteration in color due to photography be invoked in the event of a discrepancy with the photo available on the website.

This site contains links to other websites. BOUTIQUE PAPYMOUSSE cannot be held responsible for the current or future content of these sites, nor for the content of external sites that link to the BOUTIQUE PAPYMOUSSE site.

Applicable jurisdiction and laws

These terms and conditions are subject to Belgian law. In the event of a dispute, Belgian law shall apply and only the courts of the judicial district of Verviers shall have jurisdiction.

Warranty

Under no circumstances shall BOUTIQUE PAPYMOUSSE be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt. BOUTIQUE PAPYMOUSSE's potential liability is exclusively limited to the value of the product in question, determined on the date of its sale.

Personal information

The collection of personal information for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders, issuing invoices, and drawing up warranty contracts. Failure to provide this information will result in the order not being validated.

In accordance with the law, a company that collects personal data must have the consent of the person concerned. This data must be accurate and must be collected for a specific, clear, and legal purpose.

Customers have the right to access, modify, rectify, and delete data concerning them, which they may exercise by contacting BOUTIQUE PAPYMOUSSE.

BOUTIQUE PAPYMOUSSE undertakes not to disclose its customers' contact details to third parties.

All content on the website www.boutiquepapymousse.be is protected by copyright and, in general, by the principles of intellectual property law. It may not be copied, modified, placed on another website, or published in any form whatsoever without the prior written permission of BOUTIQUE PAPYMOUSSE.

Nullity

In the event that any clause of this contract is rendered null and void by a change in legislation or regulations or by a court decision, this shall in no way affect the validity and compliance with these general terms and conditions of sale.
